National Sawmills Ltd – Payment, Allocation, Cancellation and Refund Policy

1. Payment Terms
Payment is due within 14 days from the date of invoice unless otherwise agreed in writing by National Sawmills Ltd.
All orders are processed and allocated against incoming consignments from the Peterson Sawmills factory in Rotorua, New Zealand. Due to limited production capacity and global demand, stock is assigned on a strict first-come, first-served basis.
Failure to make payment within the agreed period may result in the order being cancelled, delayed, or reallocated to alternative customers. Late payment may also affect the shipment to which your order is assigned and may extend lead times accordingly.
Goods will not be released for dispatch within the UK until full cleared funds have been received.

2. Retention of Title
All goods remain the property of National Sawmills Ltd until payment has been received in full. National Sawmills Ltd reserves the right to withhold delivery or recover goods in the event of non-payment.

3. Lead Times and Supply
All lead times provided are estimates only. Production schedules, international freight, customs clearance, and port operations may result in variations. National Sawmills Ltd cannot accept liability for delays outside of its control.
Customers acknowledge that all orders are subject to international manufacturing and logistics conditions.

4. Order Confirmation and Allocation
Orders are considered confirmed once payment or deposit has been received. Payment secures allocation within a specific production or shipping consignment.
Due to the limited availability of Peterson Sawmills equipment and parts, allocation may be reassigned where payment deadlines are not met.

5. Cancellations
Once an order has been confirmed, cancellation may not be possible. Where cancellation is accepted at the sole discretion of National Sawmills Ltd, the following may apply:
A restocking and administration fee of up to 20% of the order value.
Any additional costs already incurred including freight, handling, currency fluctuation, or storage.

6. Refunds
Refunds will only be issued once the relevant goods have been reallocated or resold. The timing of any refund will depend on market demand and shipment schedules.
Deposits paid to secure production, priority allocation, or consignment space are non-refundable, except where National Sawmills Ltd is unable to supply the goods.
Where possible, customers will be offered a credit or transfer of funds towards alternative equipment or future orders.

7. Currency and Freight
All prices are based on current exchange rates and international freight conditions. National Sawmills Ltd reserves the right to adjust pricing where significant fluctuations occur prior to shipment. Customers will be notified of any changes in advance.

8. Storage and Handling
Where goods remain unpaid or uncollected following notification of availability, National Sawmills Ltd reserves the right to charge reasonable storage and administration fees.

9. Force Majeure
National Sawmills Ltd shall not be held liable for delays or failure to supply arising from events beyond reasonable control. This includes, but is not limited to, acts of God, natural disasters, industrial disputes, shipping delays, port congestion, customs restrictions, or global supply chain disruption.

10. Acceptance of Terms
Placement of an order and/or payment of any invoice constitutes acceptance of these terms and conditions.

RENTAL TERMS POLICY

TERMS & CONDITIONS OF SUPPLY – NATIONAL SAWMILLS LTD

1. Ownership & Risk
All equipment remains the property of National Sawmills Ltd until paid for in full.
Risk transfers to the Client upon delivery or collection.

2. Equipment Responsibility
The Client accepts full responsibility for the equipment from the point of delivery, including:
Damage (including blades and consumables)
Loss or theft
Fire, flood, or accidental destruction
Misuse or negligent operation
This applies to all operators, employees, trainees, or third parties.

3. Liability & Indemnity
The Client agrees to indemnify and hold harmless National Sawmills Ltd against:
Any injury, loss, or damage arising from use of the equipment
Any third-party claims
Any costs, including legal fees

4. Insurance Requirement
The Client must maintain adequate insurance to cover:
Full replacement value of the equipment
Public liability and operator risk
Failure to insure does not reduce liability.
NATIONAL SAWMILLS LTD can request evidence of insurance cover at any time.

5. Payment Terms

Payment is due in full as stated on the invoice.
Failure to pay may result in:
Suspension of supply
Withdrawal of equipment
Reallocation of stock

6. Late Payment

Late payments may incur:
Statutory interest (under the Late Payment of Commercial Debts Act)
Recovery costs

7. Daily Penalty (Where Applicable)

Where equipment is not returned or retained beyond agreed terms:
A charge of 10% unit price per day (INC VAT) will apply until returned or replaced.

8. Condition & Return

Equipment must be returned:
In good working condition (fair wear accepted)
Complete with all parts
Repair or replacement costs will be charged to the Client.

9. No Warranty Under Training Use

No warranty is provided where equipment is used for:
Training
Multi-operator environments
Improper or unsupervised use
Blades and consumables are excluded from warranty.

10. Use & Operation

The Client is responsible for ensuring:
Safe and competent operation
Proper maintenance
Supervision of all users

11. Governing Law

These terms are governed by the laws of England and Wales.
